By accessing this website and/or purchasing equipment from the Lab, you agree to be bound by the following terms. If you do not agree to these protocols, you are not authorized to use our services.

1. THE AGREEMENT

These terms govern the sale of all products by Setup Lab to the "User" (you). By placing an order, you warrant that you are at least 18 years of age and have the legal capacity to enter into a binding contract in South Africa.

2. PRICING & THE "ZAR" CLAUSE

  • Currency: All prices are listed in South African Rand (ZAR) and include VAT unless otherwise stated.

  • Volatility: Because we source premium materials and components, we reserve the right to adjust pricing without notice to account for ZAR/USD exchange rate fluctuations or increases in raw material costs (e.g., steel or timber).

  • Errors: In the event of a "Gross Clerical Error" (e.g., a R5,000 item listed for R50), Setup Lab is not obligated to honor the price and will offer a full refund instead.

3. PAYMENT & SECURITY

  • We utilize secure, third-party payment gateways (e.g., PayFast, Yoco, Peach Payments).

  • Setup Lab does not store your credit card details. We are not liable for security breaches occurring on the side of the payment provider or your banking institution.

4. DELIVERY & TRANSFER OF RISK

  • The Handover: Our responsibility for the condition of the goods ends once the package is signed for at your delivery address.

  • The "Courier Rule": While we facilitate shipping via premium couriers, we are not liable for delays caused by strikes, civil unrest, or "Act of God" events (including Stage 4+ load shedding affecting logistics hubs).

  • Waybill Verification: If you sign a waybill without noting "Damaged" or "Unchecked," you waive your right to claim for transit-related structural damage.

5. ASSEMBLY & USER LIABILITY

CRITICAL PROTECTION: Most Setup Lab products require manual assembly.

  • Installation: Setup Lab is not responsible for any damage to your property (including but not limited to floors, walls, or existing hardware) during the installation of our products.

  • Structural Integrity: We are not liable for injuries or equipment failure resulting from improper assembly, overloading beyond weight capacities, or unauthorized modifications (drilling/welding).

  • Hardware: It is your responsibility to ensure that the tools used for assembly are of the correct size and type to avoid stripping screws or damaging frames.

6. FORCE MAJEURE (EVENTS BEYOND CONTROL)

Setup Lab shall not be liable for any failure to perform its obligations where such failure is due to:

  • National power grid failure or prolonged load shedding.

  • Global supply chain disruptions.

  • Regional civil unrest or "Stay-away" actions.

  • Pandemic-related lockdowns.

7. INTELLECTUAL PROPERTY

All designs, product names, "Setup Lab" branding, and website HTML/CSS are the intellectual property of Setup Lab. Any unauthorized reproduction or "copy-cat" manufacturing of our designs will be met with legal action under South African IP law.

8. LIMITATION OF LIABILITY

To the maximum extent permitted by the Consumer Protection Act (CPA), Setup Lab’s total liability for any claim shall not exceed the purchase price of the specific product that caused the alleged loss. We are not liable for "Consequential Loss"—meaning we won't pay for your lost business revenue if a desk delivery is late or a component fails.

9. GOVERNING LAW

These terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the courts in the district where Setup Lab is headquartered.
